Letter to Governor from Vanessa Sawyer and Collette Wise

Dear Governor Michelle Lujan Grisham,

Our names are Vanessa Sawyer and Collette Wise. We are the grandmother and mother of Bennie Hargrove who tragically passed away on August 13, 2021, from unnecessary and preventable gun violence at Washington Middle School in Albuquerque, New Mexico. We are pleading to you to make the Bennie Hargrove Gun Safety Act a part of your agenda during this 2022 Legislative Session. As a mother, we know that you must understand our frustration and anger in learning that the parents of our son’s murderer, who recklessly allowed their middle school aged son constant access to a firearm that was used in the murder and execution of our 13-year-old son Bennie Hargrove, are free from any criminal charges and prosecution. We know that you can understand our confusion and disbelief when the Albuquerque District Attorney told us that no current criminal statutes exist that could be applied to Juan and Luz Saucedo for their actions. The community has been outraged by this turn of events as no one can believe that these reckless gun owners have no criminal charges and are currently able to walk down to the local gun store and replace the firearm that was used to kill our Bennie. We must hold people accountable for their actions and involvement in the illegal use of firearms in this great State of New Mexico and protect New Mexico children from this unnecessary gun violence into the future. We as the family of Bennie Hargrove are pleading to you as the Governor of New Mexico to take this historic step and hold parents accountable for their reckless gun storage and improper access of the firearms to children and/or violent or mentally disturbed household members. We must stop the preventable
deaths of New Mexico’s children and make sure the situation that occurred on August 13, 2021, does not happen to another family.

Statement for Bennie Hargrove

We are here for the justice owed to Bennie Hargrove. On August 13, 2021, Bennie Hargrove took heroic actions to stand up against a bully who was harassing younger children and came to their aid as Washington Middle School and APS staff watched and did nothing. This Bully made a monstrous decision to shoot and execute Bennie with a handgun provided to him by the Saucedo family.  We now know that this confrontation and murder of Bennie Hargrove was stoppable by Washington Middle School and APS because the Bully was tormenting these same children and Bennie the day before on school grounds and during school hours. Under APS’ policies and procedures, the Bully should have already been suspended from school on the day Bennie was murdered. Further, Washington Middle School and APS staff watched the confrontation between Bennie, the young children, and the Bully occur without any intervention as required by their policies.

  Instead, Bennie confronted this Bully and took it upon himself to come to the aid of the younger children because they were not being protected by the school staff. As a result of his heroic actions, Bennie was killed protecting these children and other schoolmates from physical violence and potential death as shown by the Bully’s intentions to use his family’s firearm at the school on August 13th. The blood of Bennie is on the hands of the Saucedo family, Washington Middle School, and APS for their failures which allowed this dangerous situation to occur. Latest Legal Changes

The Governor recently announced new guidance for small groups this fall. Youth sports conditioning and practice is allowed as long as groups consist of 10 or fewer individuals, but contact and competitive play are still not permitted. Overnight camping at state parks is also now permitted with the same restrictions on group sizes.

In addition, some facilities are permitted to re-open with restrictions in place, including pumpkin patches, ice-skating rinks and swimming pools.
