Letter to Governor from Vanessa Sawyer and Collette Wise

Letter to Governor from Vanessa Sawyer and Collette Wise

Dear Governor Michelle Lujan Grisham,

Our names are Vanessa Sawyer and Collette Wise. We are the grandmother and mother of Bennie Hargrove who tragically passed away on August 13, 2021, from unnecessary and preventable gun violence at Washington Middle School in Albuquerque, New Mexico. We are pleading to you to make the Bennie Hargrove Gun Safety Act a part of your agenda during this 2022 Legislative Session. As a mother, we know that you must understand our frustration and anger in learning that the parents of our son’s murderer, who recklessly allowed their middle school aged son constant access to a firearm that was used in the murder and execution of our 13-year-old son Bennie Hargrove, are free from any criminal charges and prosecution. We know that you can understand our confusion and disbelief when the Albuquerque District Attorney told us that no current criminal statutes exist that could be applied to Juan and Luz Saucedo for their actions. The community has been outraged by this turn of events as no one can believe that these reckless gun owners have no criminal charges and are currently able to walk down to the local gun store and replace the firearm that was used to kill our Bennie. We must hold people accountable for their actions and involvement in the illegal use of firearms in this great State of New Mexico and protect New Mexico children from this unnecessary gun violence into the future. We as the family of Bennie Hargrove are pleading to you as the Governor of New Mexico to take this historic step and hold parents accountable for their reckless gun storage and improper access of the firearms to children and/or violent or mentally disturbed household members. We must stop the preventable
deaths of New Mexico’s children and make sure the situation that occurred on August 13, 2021, does not happen to another family.

Sincerely,
Vanessa Sawyer and Collette Wise

Statement for Bennie Hargrove

Statement for Bennie Hargrove

Statement for Bennie Hargrove

We are here for the justice owed to Bennie Hargrove. On August 13, 2021, Bennie Hargrove took heroic actions to stand up against a bully who was harassing younger children and came to their aid as Washington Middle School and APS staff watched and did nothing. This Bully made a monstrous decision to shoot and execute Bennie with a handgun provided to him by the Saucedo family.  We now know that this confrontation and murder of Bennie Hargrove was stoppable by Washington Middle School and APS because the Bully was tormenting these same children and Bennie the day before on school grounds and during school hours. Under APS’ policies and procedures, the Bully should have already been suspended from school on the day Bennie was murdered. Further, Washington Middle School and APS staff watched the confrontation between Bennie, the young children, and the Bully occur without any intervention as required by their policies.

Instead, Bennie confronted this Bully and took it upon himself to come to the aid of the younger children because they were not being protected by the school staff. As a result of his heroic actions, Bennie was killed protecting these children and other schoolmates from physical violence and potential death as shown by the Bully’s intentions to use his family’s firearm at the school on August 13th. The blood of Bennie is on the hands of the Saucedo family, Washington Middle School, and APS for their failures which allowed this dangerous situation to occur. That is why the Law Office of Adam Oakey, LLC and the family of Bennie Hargrove are going to seek justice for Bennie.  #Justice4Bennie

Dealing With COVID-19 in New Mexico

Dealing With COVID-19 in New Mexico

Dealing with COVID-19 in New Mexico

COVID-19 has turned our entire world upside down, and we’ve all had to make adjustments to deal with the way it’s changed things. From mask mandates to a new way of doing business, everyone’s doing the best they can, and that includes the attorneys who are here to protect your rights, whether civil or criminal. Let’s look at the way we’re all dealing with COVID-19 laws, mandates and responsibilities here in New Mexico and find out what you can do if you need legal representation.

Latest Legal Changes

The Governor recently announced new guidance for small groups this fall. Youth sports conditioning and practice is allowed as long as groups consist of 10 or fewer individuals, but contact and competitive play are still not permitted. Overnight camping at state parks is also now permitted with the same restrictions on group sizes.

In addition, some facilities are permitted to re-open with restrictions in place, including pumpkin patches, ice-skating rinks and swimming pools.

Ongoing Cases

In a few states across the country, there are open court cases challenging governors’ rights to affect shutdowns. While such a case hasn’t hit New Mexico yet, federal rulings on these cases could set an important precedent moving forward. Until then, however, know that your New Mexico personal injury and criminal defense attorneys are watching, listening and ready to defend your rights every step of the way.

How Attorneys Are Dealing With the Changes

The state bar in New Mexico is recommending that attorneys use videoconferencing services to conduct as many of their meetings as possible virtually. We are working hard to meet our clients’ needs while still keeping everyone as safe as possible during this trying time. We’re happy to talk over the phone about the changes we’re making and how we can keep you safe and still represent your rights.

If you’re in need of legal representation, don’t let COVID-19 stop you from seeking help. Reach out to the Law Office of Adam Okey LLC and let us help you. Contact us for a free case evaluation today!

Why Hire an Albuquerque Personal Injury Lawyer?

When you’re hurt in an accident and it’s someone else’s fault, it’s a scary, angry and confusing time. Your entire life can be changed in an instant, turned completely upside down. You may be facing expensive medical bills that you can’t pay because you’re unable to work. You’re overwhelmed with feelings of fear, anxiety, anger, depression and even guilt. You have rights, and you deserve to be compensated for all of this. Getting that compensation, however, requires help from a qualified Albuquerque personal injury lawyer.

Fighting the Bullies

When you get hurt, you’ll be visited by an insurance adjuster from the other side. They will make a lowball offer for your suffering while pretending to be compassionate and caring. When you refuse, they will often turn to bullying, resort to strongarm tactics or threaten you with no settlement at all. A personal injury attorney can stand up to them and fight back. You don’t have to take it; just refer them to your attorney.

Proving Negligence

Negligence is the legal concept at the core of every personal injury case. It’s deceptively simple but very difficult to prove. In order to demonstrate the other party was negligent, you have to prove three factors

  1. The other person acted irresponsibly, acted in a way that a reasonable person wouldn’t act under similar circumstances or failed to act in a reasonable and responsible way.
  2. Their behavior, actions or lack of action was the cause of the accident that happened.
  3. The accident was the direct cause of your injury.

New Mexico also uses a comparative negligence rule, meaning that your settlement can be reduced by a percentage equal to the fault you are found to share. That’s why having an attorney is important, to protect your rights and remind everyone who the victim is.

Securing Compensation for Your Case

An attorney knows exactly how to value your case and issue a demand to the other side’s insurance company. You may be eligible to collect compensation for a wide range of damages, including:

  • Medical bills and potential future medical costs.
  • Lost wages and loss of possible future earnings.
  • Loss of consortium, comfort and relationships.
  • Pain and suffering.
  • Loss of enjoyment of life.
  • Emotional trauma, depression and PTSD.
  • In the very worst cases, punitive damages.
  • And others.

Getting full compensation for your case requires someone who really knows the law, knows how to protect your rights and will fight for justice for you.

Understanding New Mexico Family Laws?

Family law is the area of legal practice that protects you and your family in a wide range of situations. These can include divorce, child custody and support, marital property, stalking and even abortion laws. When you’re facing issues that relate to family and relationships, you need the help of an experienced and qualified attorney. Explore a brief overview of family law in New Mexico and when you should call on the services of an Albuquerque family law attorney to help.

New Mexico Divorce Laws

Divorce isn’t something anyone wants to face, but it does happen. The state has many complex issues of family law regarding who can get a divorce, how the process moves forward and even how long you must have lived in the state in order to pursue a divorce. The right New Mexico divorce attorney can help represent your best interests and make sure that the split is fair and equitable.

Child Custody and Support

One of the most painful parts of any divorce are the issues of child custody and support that result from the dissolution of the marriage. It’s always important to put the child’s best interests first, and your attorney will help you to do just that. They will help you analyze the situation and protect both your child and your parental rights in issues of custody, visitation and child support payments.

Communal Property Laws

It can be tricky to understand how property laws work when the time comes to split your assets after a divorce. Not everything is divided in half. Your attorney can educate you on what constitutes communal property, what is yours and what is your former spouse’s. This includes issues of what debts are shared and separate.

Stalking and Protection

Stalking is a real issue in New Mexico and across the country. When someone is threatening you or engaging in dangerous behavior, including persistent behavior that makes you feel uncomfortable, an attorney can help you to protect yourself, your family and your property by taking legal action against the stalker.

Reproductive Rights in New Mexico

A family law attorney also stands to represent people who are facing questions regarding their reproductive rights. The state has complex laws regarding abortions, and failing to obey these laws can actually result in felony charges. It’s important to have someone in your corner who can help to protect you if you face a difficult situation related to abortion laws.
